Clapper waives preliminary exam



CARO -- Mitchell Clapper, 33, of Sebewaing waived his right to a preliminary exam last Friday in Tuscola County.

Tuscola County District Court Judge Kim David Glaspie bound Clapper over to Tuscola County Circuit Court on April 21.

"One concern we have in a criminal sexual conduct case is having the victim(s) testify," said Tuscola County Prosecuting Attorney Mark Reene. "We don't want to have to put them through that."

On March 31, Clapper was sentenced in Huron County Circuit Court to 10 to 20 for a criminal sexual conduct (CSC) charge in the first degree.

Clapper was in Huron County Circuit Court on Feb. 6, and was found guilty by jury of one count of criminal sexual conduct first degree and one count of criminal sexual conduct second degree.

Allen reports the incidents occurred in 2003 when the victim was 10 years old.

According to Huron County Chief Assistant Prosecuting Attorney Steve Allen, the first degree CSC is a life in prison offense and the second degree CSC is a 15-year felony.

In Huron County Circuit Court Clapper is scheduled for another preliminary exam in April. Huron County Circuit Court Judge M. Richard Knoblock set a jury trial date for Aug. 26 for these charges.
